In 2022, Judge Childs was reportedly under consideration for the Supreme Court seat vacated by Stephen Breyer. President Biden appointed Childs to this appeals court.

Judge Pan is a Biden appointee too. Henderson was appointed by George HW Bush… on the bench for 34 years

First and foremost: Karen Henderson, who can be reasonable and can be not-reasonable, and who could muck up efforts to turn this thing around quickly.
Henderson–or the panel generally–may test out a narrower ruling, whether the alleged actions Trump took are officials acts. DCC already ruled they weren't.

Finally, that would leave Double Jeopardy. It's an interesting argument, hypothetically. But Trump isn't charged with the same thing he was in impeachment (incitement), perhaps intentional so. Which makes it frivolous, which should mean his appeal has to wait.

Ron Filipkowski posted a clip from a 5 minute and 58 second rambling video that Twice Impeached 45 posted to his social media site, that I continue to refuse to link too, just before midnight according to the time stamp I’m seeing…

Ron got the gist right, he basically says if he wins, he’ll indict Joe Biden, not really breaking news as Twice Impeached 45 has said if he wins 2024 he’ll go after everyone…
