Memorandum on the Deferred Enforced Departure for Certain Palestinians:

Following the horrific October 7, 2023, terrorist attack by Hamas against Israel, and Israel’s ensuing military response, humanitarian conditions in the Palestinian territories, and primarily Gaza, have significantly deteriorated.  While I remain focused on improving the humanitarian situation, many civilians remain in danger; therefore, I am directing the deferral of removal of certain Palestinians who are present in the United States.

Pursuant to my constitutional authority to conduct the foreign relations of the United States, I have determined that it is in the foreign policy interest of the United States to defer for 18 months the removal of any Palestinian subject to the conditions and exceptions provided below.

Accordingly, I hereby direct the Secretary of Homeland Security to take appropriate measures to defer for 18 months the removal of any Palestinian who is present in the United States on the date of this memorandum, except for those:

(1)  who have voluntarily returned to the Palestinian territories after the date of this memorandum;

(2)  who have not continuously resided in the United States since the date of this memorandum;

(3)  who are inadmissible under section 212(a)(3) of the Immigration and Nationality Act (INA) (8 U.S.C. 1182(a)(3)) or deportable under section 237(a)(4) of the INA (8 U.S.C. 1227(a)(4));

(4)  who have been convicted of any felony or two or more misdemeanors committed in the United States, or who meet any of the criteria set forth in section 208(b)(2)(A) of the INA (8 U.S.C. 1158(b)(2)(A));

(5)  who are subject to extradition;

(6)  whose presence in the United States the Secretary of Homeland Security has determined is not in the interest of the United States or presents a danger to public safety; or

(7)  whose presence in the United States the Secretary of State has reasonable grounds to believe would have potentially serious adverse foreign policy consequences for the United States.

I further direct the Secretary of Homeland Security to take appropriate measures to authorize employment for noncitizens whose removal has been deferred, as provided by this memorandum, for the duration of such deferral, and to consider suspending regulatory requirements with respect to F-1 nonimmigrant students who are Palestinians as the Secretary of Homeland Security determines to be appropriate.

The Secretary of Homeland Security is authorized and directed to publish this memorandum in the Federal Register.

Statement from National Security Advisor Jake Sullivan on Deferred Enforced Departure for Palestinians:

Following the horrific October 7 terrorist attack by Hamas against Israel, and Israel’s ensuing military response, humanitarian conditions in Gaza have significantly deteriorated. In light of the ongoing conflict and humanitarian needs on the ground, President Biden signed a memorandum directing the deferral of removal of certain Palestinians who are present in the United States, giving them a temporary safe haven. Specifically, President Biden is granting deferred enforced departure for 18 months to Palestinians that are currently in the United States. This grant of deferred enforced departure would provide protections for most Palestinians in the United States, with certain exceptions. Those convicted of felonies or who are otherwise deemed to pose a public safety threat are not eligible for deferred enforced departure. Anyone who voluntarily returns to the Palestinian territories would lose any such protections.

The Super Bowl is the most unifying event in America. Nothing brings more of us together. And the celebration of a Super Bowl win is a moment that brings a joy that can’t be matched to the winning team and their supporters. For this joy to be turned to tragedy today in Kansas City cuts deep in the American soul.

Today’s events should move us, shock us, shame us into acting. What are we waiting for? What else do we need to see? How many more families need to be torn apart?

It is time to act. That’s where I stand. And I ask the country to stand with me. To make your voice heard in Congress so we finally act to ban assault weapons, to limit high-capacity magazines, strengthen background checks, keep guns out of the hands of those who have no business owning them or handling them.

We know what we have to do, we just need the courage to do it.

Today, on a day that marks six years since the Parkland shooting, we learned that three police officers were shot in the line of duty in Washington, DC and another school shooting took place at Benjamin Mays High School in Atlanta.  Yesterday marked one year since the shooting at Michigan State University. We’ve now had more mass shootings in 2024 than there have been days in the year.

The epidemic of gun violence is ripping apart families and communities every day. Some make the news. Much of it doesn’t. But all of it is unacceptable. We have to decide who we are as a country. For me, we’re a country where people should have the right to go to school, to go to church, to walk the street — and to attend a Super Bowl celebration — without fear of losing your life to gun violence.

Jill and I pray for those killed and injured today in Kansas City, and for our country to find the resolve to end this senseless epidemic of gun violence tearing us at the seams.

NBC News reported that three police officers were shoot and injured while attempting to execute an arrest warrant on charges of animal cruelty. The suspect remained barricaded in the home for twelve hours shooting sporadically throughout the standoff. The officers suffered non-life threatening injuries.

Fox 5 Atlanta reported that 4 male students at Benjamin E. Mays High School were shot following a fight that started around 4 p.m. Atlanta time. The students are expected to live. No other people were injured.

ABC News reported that at the end of the KC Chiefs Super Bowl win celebration parade and rally that one person was killed and 21 others were wounded when gun fire erupted just outside Union Station.

Investigators are still working to determine the total number of victims. Twenty-two people sustained gunshot wounds and one of them died, police said. Eight of the gunshot victims were hospitalized with “immediately” life-threatening injuries and seven with life-threatening injuries, according to the Kansas City Fire Department.

Children’s Mercy Kansas City Hospital said it admitted and treated a total of 12 patients, including 11 children between the ages of 6 and 15. Nine of the patients were gunshot victims and three were being treated for “incidental injuries,” and all were expected to make a full recovery.

Officers have 3 people in custody and recovered one firearm from the scene. Police are still trying to work out the motive, but there is no evidence to suggest an act of terrorism.

The deceased was identified by her family as Lisa Lopez-Galvan, a DJ at local radio station KKFI 90.1 FM. She was 44 years old. She leaves behind her husband and two small children.

NBC News is reporting this morning…

Yesterday’s shooting came amid what “appeared to be a dispute between several people that ended in gunfire,” Kansas City Police Chief Stacey Graves told reporters today.

Graves said that two juveniles were in custody in connection with the shooting, which left at least one person dead and 23 other people injured. The police chief said investigators have not found any link to terrorism or homegrown extremism.
