G.F.F. v. Trump (S.D.N.Y.) Case No 1:25-cv-02886 | Habeas petition and Class complaint Motion for TRO | 2025-04-08 | Overview: Plaintiffs are two Venezuelan nationals (proceeding under pseudonym) in immigration custody in New York. They have filed a habeas petition asking the court to stop the government from removing them from the United States the Alien Enemies Act Presidential Proclamation, and to declare the Proclamation unlawful. The case has been brought on behalf of themselves and a class of all other persons similarly situated, to include all noncitizens from Venezuela in immigration custody in the Southern District of New York, who were, are, or will be subject to the Proclamation. The court has temporarily blocked the Defendants from removing the Plaintiffs and others similarly situated in the Southern District of New York through Apr. 23, 2025. Case Summary: On March 15, 2025, President Donald Trump published a Presidential Proclamation titled “Invocation of the Alien Enemies Act Regarding the Invasion of The United States by Tren De Aragua” (Proclamation), which sought to authorize removal of noncitizens from Venezuela who are deemed to be “enemy aliens” under the Alien Enemies Act (AEA). Petitioners are two Venezuelan men who have been arrested and detained by immigration authorities, and allegedly face imminent deportation pursuant to the Proclamation. Petitioners argue that the removal process established under the Proclamation is unlawful. They argue that such process is ultra vires under the AEA, as the AEA only authorizes removals during a declared war or invasion of the United States by a foreign nation or government, and further requires additional process prior to removing noncitizens. They also argue that the removal process violates various provisions of the Immigration and Nationality Act and Foreign Affairs Reform and Restructuring Act, including those that establish procedures and mechanisms for, as well as protections against, removal (including sending someone to a country where they are more likely than not to face torture). Finally, they argue that the removal process violates the Due Process Clause of the Fifth Amendment and the right to habeas corpus. Petitioners have brought their petition and complaint on behalf of a similarly situated class, including all noncitizens in immigration custody who were, are, or will be subject to the Proclamation. Petitioners have requested that the court certify the class, grant a writ of habeas corpus to Petitioners that enjoins Defendants from removing them pursuant to the Proclamation, and declare the Proclamation unlawful. Update 1: On Apr. 11, the court certified the class and granted a temporary restraining order preventing their removal from the district or the United States. Update 2: On Apr. 17, petitioners filed a reply in support of their motion for a preliminary injunction. The reply asserts that the government has not satisfied due process requirements under the AEA and that the proclamation violates both procedural requirements and Congressionally established protections for noncitizens seeking humanitarian protections. |

White House Considers Slashing China Tariffs to De-Escalate Trade War (gift link):
The Trump administration is considering slashing its steep tariffs on Chinese imports—in some cases by more than half—in a bid to de-escalate tensions with Beijing that have roiled global trade and investment, according to people familiar with the matter.
President Trump hasn’t made a final determination, the people said, adding that the discussions remain fluid and several options are on the table. One administration official said Trump wouldn’t act unilaterally and would need to see some action from Beijing to lower tariffs.
One senior White House official said the China tariffs were likely to come down to between roughly 50% and 65%. The administration is also considering a tiered approach similar to the one proposed by the House committee on China late last year: 35% levies for items the U.S. deems not a threat to national security, and at least 100% for items deemed as strategic to America’s interest, some of the people said. The bill proposed phasing in those levies over five years.

Draft executive order outlines plan to integrate AI into K-12 schools (04/22/2025):
The Trump administration is considering issuing an executive order that would create a policy integrating artificial intelligence into K-12 education, according to a draft circulated by the White House to several federal agencies on Monday and obtained by The Washington Post.
Under the draft executive order, federal agencies would be instructed to take steps to train students in using AI and to incorporate itinto teaching-related tasks. The agencies would also be asked to partner with the private sector to develop relevant programs in schools. The draft is marked “predecisional” and could be subject to change before it is signed, or it could be abandoned.
AI is “driving innovation across industries, enhancing productivity, and reshaping the way we live and work,” the draft order reads. “To ensure the United States remains a global leader in this technological revolution, we must provide our Nation’s youth with opportunities to cultivate the skills and understanding necessary to use and create the next generation of AI technology.”
[snip]
Titled “Advancing artificial intelligence education for American youth,” the draft order would establish a White House task force on AI education that would be chaired by Michael Kratsios, director of the Office of Science and Technology Policy, and would include the secretaries of education, agriculture, labor and energy, as well as Trump’s special adviser for AI and cryptocurrency, David Sacks.

When you click open the tweet; it’s the article…
The past week has shown Americans everything they need to know about Democrats’ priorities. On Monday, four more Democrats — Rep. Robert Garcia of California, Rep. Maxwell Frost of Florida, Rep. Yassamin Ansari of Arizona, and Rep. Maxine Dexter of Oregon — are in El Salvador, picking up their party’s mantle of prioritizing a deported illegal immigrant MS-13 gang member over the Americans they represent. Why hasn’t Rep. Dexter spoken about these illegal immigrants putting her region at risk?
- Alvaro Flores-Barboza, a 24-year-old citizen of Venezuela, escaped from an ICE processing facility before he was arrested in Portland, Oregon. He has convictions for assault, reckless driving, and felony use of a weapon.
- Juan Jose-Sebastian, a 26-year-old citizen of Guatemala, was arrested in West Palm Beach, Florida. He is wanted for 2017 rape and sexual assault charges in Washington County, Oregon. He was arrested in Florida in 2024 for driving without a license — but was released onto the streets because the Biden Administration refused to take custody of him and Oregon officials refused to extradite him.
Why hasn’t Rep. Ansari spoken about these illegal immigrants putting her region at risk?
- Bonifacio Renteria-Cruz, a 48-year-old citizen of Mexico, was arrested in Phoenix, Arizona. He has ties to the Sinaloa Cartel and has convictions for aggravated assault and weapons charges. He also has an active arrest warrant for homicide in Mexico.
- Jose Escobar-Robles, a citizen of Mexico, was arrested in Phoenix, Arizona. He is believed to be illegally funneling money to Mexico to benefit violent cartels engaged in drug smuggling and human trafficking.
- Luis Garcia-Sanchez, a citizen of Mexico, was arrested in Phoenix, Arizona. He is connected to the notorious 18th Street Gang and has been wanted for felony narcotics charges dating back to 1987.
- Edgar Guadalupe Jimenez-Aguilar, an illegal immigrant, was arrested in Phoenix, Arizona. He was wanted on charges of conspiracy to transport illegal aliens and possession with intent to distribute heroin.
Why hasn’t Rep. Frost spoken about these illegal immigrants putting his region at risk?
- Franklin Jose Jimenez-Bracho, a member of the Tren de Aragua gang, was arrested near Orlando, Florida. He was wanted for human trafficking and smuggling.
- Juan Andres Borolo Moreno Romero, a 25-year-old citizen of Venezuela, was arrested by ICE in Orlando, Florida. He is a known member of the brutal Tren de Aragua gang.
- Paula Hernandez Lazaro, a citizen of Mexico, was arrested near Orlando, Florida. She crashed into a patrol car and another vehicle, sending a police officer to the hospital.
- Five illegal immigrant members of the brutal Tren de Aragua gang were arrested after a string of liquor store thefts and robberies in Polk County, Florida. The five have lengthy criminal histories, including “immigration violations, thefts, robbery, drug possession, resisting arrest, fraudulent use of and possession of personal identification, false reports to law enforcement, robbery with a firearm, aggravated assault with a deadly weapon, domestic violence (listed as armed and dangerous), and driver’s license offenses.”
Why hasn’t Rep. Garcia spoken about these illegal immigrants putting his region at risk?
- Mario Edgardo Garcia Aquino, a 43-year-old citizen of El Salvador, arrested in Los Angeles. He is charged with first-degree murder in the brutal slaying of a 13-year-old soccer player in Los Angeles, who was found discarded on the side of the road, and with the sexual assault of another young teenager in 2022.
- Noe Diaz De Leon, a citizen of Mexico, arrested by ICE Los Angeles. He has convictions for attempted murder of a peace officer, burglary, and possession of a controlled substance.
- Boxiao Song, a citizen of China, arrested by ICE Los Angeles. He is a convicted child sex offender.
- Seung Hun Baik, a 39-year-old citizen of South Korea, arrested by ICE Los Angeles. He is wanted in his home country for an aggravated offense involving psychotropic drugs.
I really hate it here.
We pay for people to run the White House account and this is how they decide to spend our money and their time. Due process matters. They admitted they sent Garcia to El Salvador by mistake. Courts have ruled that he needs to be brought back here to go through the proper process to either deport him or allow him to return to his family.
It doesn’t have to be a binary choice; our support for Garcia’s return does not = us supporting all criminals ever.
I saved this because the Washington Post has a very good fact-checking system; they usually link to a bunch of things, that help the reader verify their fact-checkers. They aren’t as good as Daniel Dale, who is? But they do make fact-checking the fact-checkers easier than most places.
Fact Checker by Glenn Kessler: President Trump inflates tariff revenue by 10 times and accuses Joe Biden of “losses” that exist in his imagination.

Best we can tell, Trump was talking about something completely different — and equally wrong. https://t.co/HwP862qpwt
“On trade and other things, we’re doing great. We’re taking in billions and billions of dollars. … We were losing $2 billion a day. … This is the biggest deal ever made. Now we’re making $3 billion a day.”
— President Donald Trump, remarks to reporters during a meeting with President Nayib Bukele of El Salvador, April 14
A few days before the president made these comments, we gave Four Pinocchios to Peter Navarro, the president’s senior counselor, for claiming that Trump’s tariffs would raise $600 billion a year, or $6 trillion over 10 years. We showed that Navarro appeared to have assumed that a 20 percent tariff on $3 trillion of imports would result in a bonanza — without considering the effects of people changing their buying habits when tariffs increase, countries retaliating and the subsequent impact on other revenue sources.
[snip]
As we regularly remind readers, economists agree that tariffs — essentially a tax on domestic consumption — are paid by importers, such as U.S. companies, which in turn pass on most or all of the costs to consumers or producers who may use imported materials in their products. As a matter of demand and supply elasticities, overseas producers will pay part of the tax if there are fewer goods sold to the United States. Domestic producers in effect get a subsidy because they can raise their prices to the level imposed on importers.
[snip]
As for Biden “losing $2 billion” a day, Trump is changing metrics. He appears to be referring to the daily average of the trade deficit. The goods and service deficit was nearly $920 billion in 2024, according to the Commerce Department, or about $2.5 billion a day.
As we’ve been reminding people since 2015, Trump frequently says the United States is “losing money” when there is a trade deficit, but that reflects a fundamental misunderstanding. A trade deficit simply means that people in one country are buying more goods from another country than people in the second country are buying from the first country.
[snip]
The Pinocchio Test
Trump is peddling two nonsense numbers. First, that tariffs are already bringing in $3 billion a day. He’s off by a factor of 10. Second, that Biden was losing $2 billion a day. That reflects a misunderstanding of trade — though with profound consequences.
Trump earns Four Pinocchios.

From the State Department.
Building an America First State Department
We are facing tremendous challenges across the globe. To deliver on President Trump’s America First foreign policy, we must make the State Department Great Again.
In its current form, the Department is bloated, bureaucratic, and unable to perform its essential diplomatic mission in this new era of great power competition. Over the past 15 years, the Department’s footprint has had unprecedented growth and costs have soared. But far from seeing a return on investment, taxpayers have seen less effective and efficient diplomacy. The sprawling bureaucracy created a system more beholden to radical political ideology than advancing America’s core national interests.
That is why today I am announcing a comprehensive reorganization plan that will bring the Department into the 21st Century. This approach will empower the Department from the ground up, from the bureaus to the embassies. Region-specific functions will be consolidated to increase functionality, redundant offices will be removed, and non-statutory programs that are misaligned with America’s core national interests will cease to exist.
Under President Trump’s leadership, we have a commander in chief committed to putting America and Americans first. As his Secretary of State, I am confident a reformed State Department will meet the moment and help make our country great once again.
Click here to view the new organizational chart for the U.S. State Department [82 KB]. The Department will implement the changes methodically over the next several months.

A key piece of the Trump administration’s plan to rapidly expand immigration detention capacity appears to have fallen through as a contract for a sprawling tent city in Texas was terminated, according to a government document reviewed by NBC News. https://t.co/zZLfN73uIR
— NBC News (@NBCNews) April 23, 2025
A key piece of the Trump administration’s plan to rapidly expand immigration detention capacity by tens of thousands of beds appears to have fallen through, according to two sources and a government contracting document reviewed by NBC News.
Facing a shortage of immigration detention space, President Donald Trump first announced he would add 30,000 beds for immigrants at Guantánamo Bay, the U.S. naval base in Cuba. When that plan fell through over cost and logistical issues, the plan shifted to Fort Bliss, a military base in Texas, to build a sprawling tent city for immigrants to be held before deportation.
A $3.8 billion contract was awarded to Deployed Resources, a contractor that has previously provided toilets and tents for concertgoers, victims of natural disasters and, more recently, migrants who were briefly detained and processed by Border Patrol.
But last week, new language appeared on the Deployed Resources contract posted to a public records database that says it was terminated. The document says it was terminated “for convenience” and cites Trump’s executive order about “radical transparency” and “wasteful spending,” but it is unclear whether cost savings played into the decision.
Representatives for Deployed Resources did not respond to multiple requests for comment.

After a month of searching, man learns from NBC News that DHS sent his brother to El Salvador. https://t.co/chN70bSMey
— NBC News (@NBCNews) April 23, 2025
It was March 13 when Nedizon Alejandro Leon Rengel called his brother Neiyerver Adrián Leon Rengel to wish him a happy birthday.
Alejandro never heard back from him. Federal agents detained Adrián on his way to his job at a Dallas barbershop.
For the next five weeks, Alejandro has searched for Adrián, trying to learn where he was: deported to another country? Held in an immigration facility in the United States?
He and Adrián’s live-in girlfriend called Immigration and Customs Enforcement in Texas, getting shifted from office to office with different responses.
Sometimes they were told Adrián was still in detention. Another time they were told that he had been deported back to “his country of origin,” El Salvador, even though Adrián is Venezuelan. (Alejandro provided NBC News with audio recordings of the calls.)
[snip]
Finally, on Tuesday, an answer. The Department of Homeland Security confirmed to NBC News that Adrián had, in fact, been deported — to El Salvador.
The news “saddens me a lot” and “shattered me,” Alejandro said after he heard about his brother’s whereabouts from NBC News.
DHS didn’t respond when it was asked whether Adrián was sent to CECOT, the mega-prison in El Salvador. But Alejandro fears that’s the case, given the many Venezuelans who were sent to CECOT from Texas a few days after he was detained.
[snip]
Adrián had a crown tattoo with the initial “Y,” the first letter of his ex-wife’s name, on his hand, Alejandro said. When he was arrested in November, officers told him they were linking him to Tren de Aragua “because of that tattoo,” Alejandro said.
That’s why he later covered it with a tiger tattoo, Alejandro said. ICE has pointed to tattoos, including those of a crown, as indicators of membership in Tren de Aragua. Adrián also has a tattoo of his mother’s name on one of his biceps.

Show more =’s Ricardo Jesus Prada Vasquez is a Venezuelan national and confirmed member of Tren de Aragua, entered the United States on Nov. 29, 2024 at the Brownsville, Texas Port of Entry via a CBP One app appointment. Prada was paroled into the US and served with a notice to appear before an immigration judge. On Jan. 15, Prada was encountered at the Detroit Windsor Tunnel in Detroit, Michigan attempting to enter the U.S. from Canada and was referred to secondary inspection. Further investigation resulted in Prada being designated a public safety threat as a confirmed member of TdA and in violation of his conditions of admission. Prada was apprehended and transferred to ICE Michigan for detention. On Feb. 27, an immigration judge ordered Prada removed from the U.S. On March 15, Prada was removed to El Salvador.
In the other story from NBC News regarding a different missing person that has been found in El Salvador, shared above, Tricia said to them; “Neiyerver Adrian Leon Rengel, entered our country illegally in 2023 from Venezuela and is an associate of Tren De Aragua,” DHS Assistant Secretary Tricia McLaughlin told NBC News by email. “Tren de Aragua is a vicious gang that rapes, maims, and murders for sport. President Trump and [DHS] Secretary [Kristi] Noem will not allow foreign terrorist enemies to operate in our country and endanger Americans. They will always put the safety of the American people first.” Asked for details and documents supporting DHS’ allegations of criminality, McLaughlin responded: “We aren’t going to share intelligence reports and undermine national security every time a gang member denies he is one.
