Special Counsel Robert Mueller on Tuesday recommended that former National Security adviser to President Trump, Michael Flynn, serve no jail time citing Flynn’s “substantial assistance,” with several ongoing investigations, according to a new court filing.
Flynn was fired in February 2017. The Washington Post reported at the time that Flynn resigned once it was discovered he mislead senior Trump officials, including Vice President Mike Pence, over conversations Flynn had with Russian Ambassador Sergey Kislyak during the transition.
In December of 2017 Flynn pleaded guilty to one felony count of making a false statement and was said to be cooperating with Mueller.
According to the Tuesday court filings which is heavily redacted, Flynn has assisted the Special Counsel’s Office investigation concerning “any links or coordination between the Russian Government and individuals associated with” the Trump campaign.
Flynn, the document says, has participated in 19 interviews, provided documents and communications not only to Special Counsel’s Office, but also other attorney’s from the DOJ.
The non-redacted court filing details Flynn’s misleading statements, for example: on page 3 of the document Flynn on January 24th, 2017, told the FBI, “he did not ask the Russian Ambassador to refrain from escalating the situation in response to sanctions,” when later he admitted he did discuss sanctions with the Russian Ambassador during the transition.
In the redacted court filing Flynn has “assisted with several ongoing investigations: a criminal investigation,” which is redacted from the document and “the special Counsel’s Office investigation concerning any links or coordination between the Russian government and individuals associated with the campaign of,” President Trump.
The government explains in the redacted memo, that some of Flynn’s “substantial assistance,” might not be fully realized at this time “because the investigations are ongoing.”
For what it’s worth on page 4 in the redacted memo Mueller’s Office writes, “Several senior members of the transition team publicly repeated false information conveyed to them by the defendant about communications between him and the Russian ambassador regarding sanctions.”
Flynn is scheduled to be sentenced on December 18th, 2018 according to the court documents.
