In 2013 President Obama’s campaign was fined $375,000 Politico reported at the time that the fine resulted from his 2008 campaign. According to the January 2013 article the “major sticking point for the FEC appeared to be a series of missing 48-hour notices for nearly 1,300 contributions totaling more than $1.8 million — an issue that lawyers familiar with the commission’s work say the FEC takes seriously. The notices must be filed on contributions of $1,000 or more that are received within the 20-day window of Election Day.” Katie Hogan a President Obama spokesperson told Politico, “At the time, the 2008 campaign was record breaking, with over 3 million grass-roots donors. The very few outstanding questions about the $750 million that was raised have now all been resolved.”

On Tuesday when Michael Cohen appeared before a judge to enter his guilty plea to eight criminal counts as was reported @ The News Blender he according to CNN, implicated the President, regarding the payments he made to two women that allege they had affairs with then-businessmen Trump during 2006-2007. Cohen says that in order to keep the information from harming then-candidate Trump’s bid to be President that he, “in coordination and at the direction of a candidate for federal office,” he arranged the two payments.

As was reported @ The News Blender Cohen’s attorney Lanny Davis aired on CNN, a recording of a conversation between candidate Trump and Cohen, that Cohen secretly had made, that appears to reference one payment to Playboy model Karen McDougal.

For What It’s Worth: Washington Post writer Philip Bump explains that while to a “layperson,” these charges against Cohen, might seem like a “noxious example of business as usual in politics,” It’s not as Cohen made that clear when he accepted his plea deal when he said, “in coordination with and at the direction of a candidate for federal office,” and then when Cohen said, “for the principal purpose of influencing the election.”

Bump continues to explain that while some argue the “dubious legality,” of making a payment to bury a story, and that such payments legality is dependent on “the relationship of the person making the payment to the campaign and whether such payments were in the standard course of practice of his business.” In the case of Cohen based on his “sworn assertions,” inside the courtroom Cohen makes it clear he was not acting as a “Trump Organization attorney,” he was acting as himself, “on behalf of the campaign.” Which would make the expenditure campaign-related.
